Abstract/Sommario: Il manuale è frutto della collaborazione della Corte europea dei diritti dell'uomo e dell'Agenzia dell'Unione europea per i diritti fondamentali, che hanno assunto l'impegno congiunto di divulgare e facilitare la comprensione dei principi comuni elaborati dalla Corte di giustizia dell'Ue e della Corte europea dei diritti dell'uomo in materia di non discriminazione. Il primo capitolo ha carattere introduttivo ed illustra le origini del diritto sulla non discriminazione in Europa e gli s ...; [Leggi tutto...] Il manuale è frutto della collaborazione della Corte europea dei diritti dell'uomo e dell'Agenzia dell'Unione europea per i diritti fondamentali, che hanno assunto l'impegno congiunto di divulgare e facilitare la comprensione dei principi comuni elaborati dalla Corte di giustizia dell'Ue e della Corte europea dei diritti dell'uomo in materia di non discriminazione. Il primo capitolo ha carattere introduttivo ed illustra le origini del diritto sulla non discriminazione in Europa e gli sviluppi attuali e futuri di questa materia sotto un profilo sia sostanziale, sia processuale. In effetti, sebbene l’espressione "diritto europeo della non discriminazione" lasci supporre l’esistenza di un unico sistema europeo contro la discriminazione, in realtà quest’ultimo è costituito da un quadro di norme elaborate in molteplici contesti. Il manuale attinge principalmente alla giurisprudenza della Corte europea dei diritti dell'uomo e al diritto dell’Unione. A questi due sistemi - che hanno origini distinte e sono stati formati in periodi diversi e per ragioni differenti - il manuale fa riferimento in maniera complementare, attingendo a entrambi in modo intercambiabile quando si sovrappongono, ed evidenziandone le differenze laddove riscontrabili. Il secondo capitolo definisce categorie e tutele legate al concetto di non discriminazione, approfondendo in particolare il significato delle discriminazioni dirette e indirette, di alcune loro manifestazioni specifiche e del modo in cui esse operano nella pratica, attraverso l’analisi della giurisprudenza. Vengono, inoltre, esaminate le modalità di funzionamento delle deroghe ed eccezioni al divieto di discriminazione. Il capitolo terzo prende in esame l'ambito di applicazione del diritto europeo della non discriminazione, evidenziando i "beneficiari" delle tutele attualmente previste e gli sviluppi attesi. Il capitolo quarto analizza i motivi di discriminazione oggetto di protezione, nello specifico: sesso; orientamento sessuale; disabilità; età; razza, origine etnica, colore e appartenenza a minoranze nazionali; nazionalità e origine nazionale; religione; lingua; origine sociale, nascita e ricchezza; opinioni politiche o altre convinzioni personali. Chiude il manuale un capitolo sulle questioni probatorie in materia di non discriminazione, con attenzione particolare alla questione della ripartizione dell'onere della prova tra attore e convenuto e ai fattori che non occorre provare.

Abstract/Sommario: This report maps, analyses and discusses key dimensions and indicators for a comparative framework of industrial relations. It then identifies and assesses existing data sources that can be used to measure the different dimensions of the comparative framework. Lastly, it identifies possible data gaps that may be filled through Eurofound’s future work in the 2017 project, ‘Application of the key dimensions of industrial relations’. It then identifies and assesses existing data sources that can be used to measure the different dimensions of the comparative framework. Lastly, it identifies possible data gaps that may be filled through Eurofound’s future work in the 2017 project, ‘Application of the key dimensions of industrial relations’. The findings highlight the relevance of the key dimensions to European governments and social partners. The conceptual framework and the key dimensions proposed may serve as a monitoring instrument to assess the developments in principles, values and their operational application in the industrial relations systems in the EU.

Abstract/Sommario: This report builds upon that earlier study, developing a dashboard of 45 indicators to assess how and to what extent the conceptual framework of these key dimensions can be applied at national level. The indicators were tested across the Member States by Eurofound’s Network of European Correspondents and show reasonable accuracy when used to map the predominant features and trends of the national industrial relations systems. Abstract/Sommario: Young people in Europe continue to experience great difficulties in the labour market. While the youth unemployment rate has started to fall in a few Member States, overall 23% of young job-seekers aged 15–24 in the EU28 could not find a job in January 2014. The number of young people who were not in employment, education or training (the NEETs group) in 2012 increased to 14.6 million, representing 15.9% of the entire population of those aged 15–29. While the youth unemployment rate has started to fall in a few Member States, overall 23% of young job-seekers aged 15–24 in the EU28 could not find a job in January 2014. The number of young people who were not in employment, education or training (the NEETs group) in 2012 increased to 14.6 million, representing 15.9% of the entire population of those aged 15–29. This report analyses the labour market situation of young people in Europe, focusing in particular on the school-to-work transition, in terms of the amount of time it takes to start the first job after education, while also monitoring the more general transition to adulthood, the age at which young people leave the parental home. It also investigates the tenacity of many young people who against the odds continue to be employed during the crisis, as well as charting their transitions from temporary to permanent contracts. Lastly, the report analyses policy measures implemented by selected Member States in support of school-to-work transitions.

I giovani in Europa continuano a incontrare grandi difficoltà a entrare nel mercato del lavoro. Anche se il tasso di disoccupazione giovanile ha cominciato a calare in alcuni Stati membri, a gennaio 2014 il 23 % dei giovani in cerca di lavoro tra i 15 e i 24 anni non era ancora riuscito a trovare un lavoro. Nel 2012 i giovani europei che non studiavano, non lavoravano né seguivano corsi di formazione (NEET) erano 14,6 milioni, una quota pari al 15,9 % della popolazione nella fascia d’età 15-29 anni. La presente relazione analizza la situazione del mercato del lavoro dei giovani in Europa, concentrandosi in particolar modo sul passaggio scuola-lavoro e monitorando anche il passaggio più generale alla vita adulta. La relazione si sofferma inoltre sulla capacità dei giovani di mantenere un’occupazione malgrado le difficoltà della crisi, tracciandone il passaggio dai contratti a tempo determinato a quelli a tempo indeterminato. Per concludere, vengono passati in rassegna i punti forti e deboli di misure politiche selezionate.

Abstract/Sommario: This report seeks to build a set of indicators to measure country performance in industrial relations in terms of these four dimensions and to develop a typology of industrial relations systems, enabling a cross-country analysis of trends. The report focuses particularly on industrial democracy, seen in this context as the core dimension of industrial relations and the most desirable model of work and employment governance.

Through interviews with migrants and representatives of organisations who may come to their aid, the report explores the heightened risks of abuse and exploitation faced by these workers, overwhelmingly female, whose fears of detection and deportation hinder their ability to ...; [Leggi tutto...] The European Union Agency for Fundamental Rights (FRA) prepared this research to analyse on the ground the situation of migrant domestic workers who are present in the European Union (EU) in an irregular situation. Through interviews with migrants and representatives of organisations who may come to their aid, the report explores the heightened risks of abuse and exploitation faced by these workers, overwhelmingly female, whose fears of detection and deportation hinder their ability to access rights from healthcare to claiming unpaid wages. The report takes an in-depth look at the situation in 10 EU Member States, finding that employers largely determine and often limit migrants’ ability to access their rights. Awareness-raising – among the migrants themselves, employers and wider society – of those rights is crucial to efforts to safeguard them.

L’Agenzia dell’Unione europea per i diritti fondamentali (Fra) ha realizzato uno studio in 10 paesi membri sulle condizioni degli immigrati irregolari impiegati come lavoratori domestici. Attraverso interviste con immigrati e rappresentanti di organizzazioni di sostegno all'immigrazione, la ricerca analizza i principali rischi di abuso e sfruttamento cui sono esposti questi lavoratori, per lo più donne, spesso vittime di forme di discriminazione multipla, vittime di abusi sessuali e discriminazione razziale. Le condizioni di lavoro sono generalmente pessime: orari lunghissimi, scarsa retribuzione, assenza di periodi di riposo, così come di ferie e congedi di malattia retribuiti. Considerato che sono spesso i datori di lavoro a limitare la capacità degli immigrati ad accedere ai propri diritti, diviene fondamentale la sensibilizzazione di questi soggetti e della società in generale, ma anche degli immigrati stessi perchè prendano progressiva coscienza dei loro diritti come esseri umani prima ancora che come lavoratori.
