The study assesses the scope and implications of Article 80 of TFEU (Treaty on the Functioning of the European Union) which relates to the principle of solidarity in the field of border checks, asylum and immigration. The study analyses primary and secondary sources of European law in order to identify the implications of Article 80 TFEU in terms of obligations and jurisdiction. It also discusses the results of a questionnaire that was administered to senior public officials in the EU, collecting their views on the scope and possible mode of implementation of Article 80 TFEU. The study’s conclusions outline some practical solutions for the implementation of new solidarity mechanisms in the field of EU immigration and asylum policies.
Lo studio analizza l'ambito e le implicazioni dell'articolo 80 del Trattato sul funzionamento dell'Unione europea che fa riferimento al principio di solidarietà in materia di controlli alle frontiere, asilo e immigrazione. Vengono prese in considerazione fonti primarie e secondarie del diritto comunitario allo scopo di definire le implicazioni dell'articolo 80 in termini di adempimenti e giurisdizione. Nell'ambito dello studio, inoltre, vengono presentati e discussi i risultati di un questionario somministrato a funzionari pubblici senior Ue riguardo ambito di applicazione e possibile modalità di attuazione dell'articolo in questione. Nelle conclusioni dello studio, vengono illustrate alcune soluzioni pratiche per l'implementazione di nuovi meccanismi di solidarietà nel campo delle poltiche Ue su immigrazione ed asilo.
